SMEs Digital Marketing
1. Introduction
These Terms and Conditions govern the use of services provided by SMEs Digital Marketing (“Company”, “we”, “our”, or “us”). By engaging our services or using our website, you (“Client”, “you”, or “your”) agree to be bound by these Terms and Conditions.
These terms apply to all digital services provided by SMEs Digital Marketing including but not limited to website development, digital marketing, branding, consulting, hosting setup, and related technical services.
2. Scope of Services
SMEs Digital Marketing provides digital services including but not limited to:
- Website development and design
- Vlogging platforms and website solutions
- Digital marketing services
- Branding and creative services
- Domain and hosting setup
- Website templates and customization
- Technical consulting and support
The specific scope, deliverables, and timelines will be defined in the project agreement or communication with the client.
3. Payment Terms
To ensure commitment and avoid project disruption, the following payment terms apply:
3.1 Standard Payment Structure
Clients must choose one of the following payment options before work begins:
Option A – Full Payment Upfront
- The full project fee is paid before the project begins.
Option B – 50% Upfront Payment
- 50% of the total project fee must be paid before the project begins.
- The remaining 50% must be paid before final delivery, launch, or transfer of the completed project.
3.2 Project Commencement
No project work will begin until the required upfront payment has been received and confirmed.
3.3 Final Delivery
Final files, website access, source code, or administrative credentials will only be released once the remaining payment has been completed.
3.4 Non-Payment
Failure to complete payment may result in:
- Suspension of project work
- Delayed delivery
- Restriction of access to project files or websites
4. Client Responsibilities
Clients agree to:
- Provide necessary content, materials, and approvals required for the project
- Respond to communication in a timely manner
- Ensure all materials provided do not violate intellectual property rights or laws
Project timelines may be extended if required information or approvals are delayed.
5. Project Changes
If the client requests changes outside the agreed project scope:
- Additional fees may apply
- Timelines may be adjusted accordingly
All change requests must be agreed upon by both parties before implementation.
6. Intellectual Property
Upon full payment of the project:
- Ownership of the final deliverables will transfer to the client.
- SMEs Digital Marketing retains the right to showcase completed work in its portfolio for marketing purposes.
7. Project Cancellation
If a project is cancelled by the client:
- Upfront payments are non-refundable, as work and resources may have already been allocated.
- Any completed work remains the property of SMEs Digital Marketing until full payment is made.
8. Limitation of Liability
SMEs Digital Marketing will not be liable for:
- Loss of business or revenue
- Website downtime caused by third-party services
- Hosting provider failures or external technical issues
9. Third-Party Services
Some services may rely on third-party platforms such as hosting providers, domain registrars, or plugins. SMEs Digital Marketing is not responsible for policy changes, outages, or issues caused by these external providers.
10. Amendments
SMEs Digital Marketing reserves the right to update these Terms and Conditions at any time. Updated versions will be published on our website.
